Of course you can, just remember to list the ScummVM official homepage
somewhere :)

One caveat that you may or may not already be aware of...
The savegame directory must -always- be writable, as some games (Fate of
Atlantis and  Day of the Tentacle come to mind, but others probably) save
'temporary state saves' before running certain cutscenes that 'break' the
curretn game. So if the user is not using a floppy or USB stick, you must
set it to a ramdisk.
